Time may be running out for epilepsy claims

The bill for medical negligence compensation claims for misdiagnosis of epilepsy at a Leicester hospital are reported to have now reached £3 million, with more than 100 cases still pending.

All of the misdiagnosis compensation claims relate to the alleged medical negligence of one consultant paediatrician there. He was suspended from practice, but has since retrained as a neurophysiologist and is now practicing again.

One of the solicitors handling the claims commented, "Each case takes as long as the panel needs, but it is going to be at least another couple of years before all the cases have gone through."

However, she is concerned that if some of the people affected do not make compensation claims soon the statute of limitations may prevent them from doing so. "People have until they are 21 to make a potential claim. After that, they will be out of time," she said.

An enquiry into the consultant's conduct found that he had misdiagnosed 618 patients, putting 500 of them on the incorrect dosage of drugs.
