Compensation claim news 13/04/2007
Six years on, ramifications of accident at work still felt.
A man who fractured his spine while working as a truck driver is poised to hear whether his third compensation claim against the national egg-delivery firm he worked for has been successful.
The spinal injury occurred in 2001 in an accident at work after the man slipped and fell between his tractor and a trailer. He believes the heavily worn industrial safety shoes he was wearing, and had complained of previously, were the cause of the fall.
Following six months off work, receiving treatment for the serious personal injury, he returned, expecting to be put on light duties. The initial compensation claim, awarded at £2,800, settled a dispute between the man and the national egg-delivery firm following his return to work.
The second compensation claim was settled at £750 after a Tribunal heard that the man had unjustly lost his position as the firm's health and safety representative.
The third compensation claim is made against the firm on the grounds that they allegedly failed to make reasonable efforts to find him an alternative, more suitable, job following his serious personal injury.
